This lawsuit alleges that First Choice Dental failed to reasonably safeguard patient information during a data incident discovered in October 2023, when cybercriminals potentially accessed the company’s systems containing sensitive Private Information. The compromised data included names, dates of birth, Social Security numbers, passport numbers, driver’s license numbers, government IDs, credit and debit card numbers, financial account information, and health data.
Plaintiffs brought claims for negligence, negligence per se, breach of implied contract, breach of fiduciary duty, invasion of privacy, unjust enrichment, and violations of Wisconsin Statute § 146.82. First Choice Dental denies all wrongdoing but agreed to settle the case.
