What Is the Circle K / Gas Express Settlement About?
The lawsuit alleges that a targeted May 2024 cyberattack on Gas Express computer systems allowed access to files that may have contained names, Social Security numbers and other private information. Plaintiffs challenge the company’s data-security practices. Gas Express d/b/a Circle K denies wrongdoing, and the court has not decided the merits.
How Much Is the Circle K Settlement Payout?
A class member can claim two years of CyEx Financial Shield Complete, including $1 million in financial-fraud insurance, and choose one cash option:
- Cash Payment A: up to $2,000 for actual documented out-of-pocket losses incurred from May 20, 2024, through September 3, 2026. This tier has a $45,000 aggregate cap.
- Cash Payment B: a one-time $50 alternative cash payment with no loss documentation. This tier is capped at 700 valid claims.
The $50 payment is not automatic. A valid and timely claim is required, and the program caps may affect availability.
Am I Eligible to File a Claim?
You may qualify if you are a living U.S. resident and Gas Express sent you a notice stating that your private information was impacted in the May 2024 data incident. Merely shopping at a Circle K or receiving an unrelated corporate notice does not satisfy the class definition.
Is the Circle K Data Incident Settlement Legit?
Yes. The State Court of Fulton County, Georgia, authorized the settlement notice. Simpluris operates the official claim site. Filing is free.
When’s the Claim Deadline?
Submit the online claim by September 3, 2026, or mail a completed and signed form postmarked by that date. The exclusion and objection deadline is the same day. The final approval hearing is scheduled for September 18, 2026.
Who Qualifies for the Circle K Settlement?
The defined class is limited to notice recipients whose information Gas Express says was impacted. The official FAQ does not define the class as every Circle K customer or employee, so publication should keep the Gas Express and notice-recipient qualifiers visible.
How Do I File a Circle K Settlement Claim Form?
Use the Unique ID and PIN from the notice to file online, or download the paper form; contact the administrator if the credentials are missing. Select monitoring and either Cash Payment A or Cash Payment B. For Cash Payment A, attach receipts, statements or other third-party records showing the loss and its connection to the incident; a personal declaration alone is insufficient. Cash Payment B requires no loss explanation. Submit early because each cash tier has a separate cap.
