Bank of America and EY MOVEit Data Breach Class Action Settlement
What Is the Bank of America and EY Settlement About?
An unauthorized party exploited a vulnerability in Progress Software’s MOVEit file-transfer application between May 27 and May 31, 2023. The affected information included personal data that Bank of America had supplied to EY. Plaintiffs allege that the defendants did not adequately safeguard that information and seek compensation for resulting harm.
Bank of America and EY dispute liability. The settlement resolves claims against them without a determination of wrongdoing; claims against Progress Software continue.
How Much Is the Bank of America and EY Settlement Payout?
Eligible class members may select one of two cash-benefit options:
- Documented losses: up to $2,500 in ordinary losses, including qualifying expenses and up to four hours of lost time at $25 per hour, plus up to $10,000 for qualifying extraordinary monetary losses.
- Alternative cash: a $100 payment instead of loss reimbursement. This amount may decrease or increase, up to $1,000, depending on participation and available funds.
Class members may also request two years of identity protection, including three-bureau credit monitoring, identity-restoration assistance and identity-theft insurance. Qualifying expenses must be connected to the incident and satisfy the notice’s conditions. The $2.5 million fund also pays approved fees, administration expenses and other authorized costs; reimbursements may be reduced if available funds are insufficient.
Am I Eligible to File a Claim?
You may qualify if you are a living person residing in the United States whose personal information was included in the Bank of America information provided to EY that was involved in the May 2023 incident. Receiving an individualized settlement notice is a useful way to identify membership.
A Bank of America account alone does not establish eligibility. Contact the administrator if you cannot locate a notice. People who validly opted out cannot receive benefits.
